CABBUDI PARTNER PRIVACY POLICY

This Privacy Policy of Cabifyx Tech Private Limited (operating under the brand name and referred to as “Cabbudi”), shall be applicable to the website of Cabbudi https://www.cabbudi.in/ and its mobile application Cabbudi Partner App (hereinafter individually or collectively referred to as the “Platform”), and is an electronic agreement formed under the Information Technology Act, 2000.

“User” shall mean an individual who has registered on the Platform as a driver or partner and uses the Platform for the purpose of offering transportation or related services in accordance with the terms of this Licence. A user of this platform is also referred to as either “YOU” or “YOUR.”

This privacy policy is a legally binding document between the user and Cabbudi. The terms of this privacy policy will be effective upon YOUR use of the Platform and will govern the relationship between user and Cabbudi for all the usages of the Platform.

The processing of Your personal data by Cabbudi shall be carried out in accordance with the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any other data protection or privacy laws, rules, or regulations as may be applicable in India from time to time (hereinafter “Applicable Law”), including consent, contractual necessity, legal compliance, and legitimate interests of Cabbudi to provide and improve its services.

1. INFORMATION COLLECTED AND USE OF INFORMATION

We collect certain information, including certain personal information, from YOU under instances like:

Certain categories of data, such as financial information, government-issued identification numbers, and criminal background verification results, may constitute Sensitive Personal Data or Information (SPDI) under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. Such information will be collected, stored, processed, and transferred strictly in accordance with the applicable laws.

2. CONSENT

By registering on or using the Platform, You provide free, specific, informed, unconditional, and unambiguous consent to the collection, use, processing, sharing, and retention of Your personal data as set out in this Privacy Policy, in accordance with applicable laws. You may withdraw Your consent at any time by contacting or writing to the Grievance Officer.

The User, as the provider of information, shall at any time while availing the services or otherwise, have the option to withdraw the consent earlier given to Cabbudi. Such withdrawal of consent shall be communicated in writing to Cabbudi. In the event that the User does not provide, or subsequently withdraws, such consent, Cabbudi shall have the right to refuse to provide the goods or services for which the said information was required.

3. RETENTION

Cabbudi retains information, including personal information, only for as long as necessary to fulfil the purposes described in this Privacy Policy, to comply with applicable legal or regulatory requirements, or as otherwise permitted by law.

Users may request the deletion of their personal information or sensitive personal data. Any personal information found to be inaccurate or deficient shall be corrected or amended, as feasible, upon the User’s request and in accordance with Applicable Law.

However, Cabbudi may retain certain data after receiving a deletion request where retention is required by law or regulation, or for purposes such as safety, security, fraud prevention, resolving disputes, enforcing agreements, or addressing issues related to the user’s account (including outstanding credits, unresolved claims, or disputes).

The duration of data retention may therefore vary depending on legal obligations, regulatory requirements, and the legitimate business purposes outlined above. Retention of personal data shall always be proportionate and limited to what is reasonably necessary for the purposes specified, in line with the Applicable Laws.

5. DATA SECURITY

Cabbudi takes appropriate organizational and technical measures, as required under applicable laws, to protect the confidentiality, integrity, and security of the information in its control. This includes ensuring that data is encrypted both in transit and at rest. While Cabbudi strives to use the Industry Standard (reasonable safeguard) to protect Your information, no method of storage or transmission over the internet is completely secure. Accordingly, Cabbudi cannot guarantee the absolute security of Your information. Cabbudi implements and maintains ‘reasonable security practices and procedures’ as prescribed under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, where applicable. Provided that Cabbudi shall not be responsible for the authenticity of the personal information or sensitive personal data supplied by the User or by any other person acting on behalf of the User.

An audit of Cabbudi’s reasonable security practices and procedures shall be carried out by an auditor at least once every year, or whenever Cabbudi undertakes a significant upgrade of its processes or computer resources.

6. DISCLOSURES AND TRANSFER

We share Your information with third parties for various purposes as detailed herein below:

  • Personal contact details (such as phone numbers) are not shared. All calls between drivers and riders are made through the in-app call facility, ensuring privacy.
Other people at the request of the passenger/rider We share data with:
  • Other people at the user’s request. For example, we share a user’s ETA and location with a friend when requested by that user.
  • Emergency services: We offer features that enable users to share their data with police in the event of an emergency or after certain incidents.
Identity and other information verification providers Third-party service providers to verify and conduct background checks on the information or documents that the drivers provide during the onboarding process or thereafter.
Hosting and IT service providers IT vendors, including cloud service providers, are required to securely store Your information, including personal and sensitive information.
Payment processing partners and vendors Payment processors and banking partners to facilitate payment transactions.

7. GRIEVANCES

If You have a grievance or complaint, questions, comments, concerns, or feedback in relation to the processing of information or regarding this Privacy Policy or any other privacy or security concern, send an email to support@cabbudi.in. You may address any complaints or discrepancies in relation to the processing of Your Personal Information to the grievance officer mentioned below.

The Grievance Officer shall acknowledge and address Your concerns. The Grievance Officer shall redress the grievances expeditiously but within one month from the date of receipt of the grievance.
